Study Guild is a free, shared flashcard community, offered as it is. These are the terms you accept by creating an account, and they are short because a fair deal does not need many words. Most of them are about one thing: what happens to a card once you have given it to a guild.
The Study Guild Privacy Notice is the other half, and says what is held and why.
1. Who may be here
You need to be 16 or over. One account per person; the account is yours, and so is whatever is done with it, so do not hand your password to anybody else. Pick a name you are content to see beside your cards — other members see your username, or your first name and last initial — and keep your email address current, since it is how you sign in and how we reach you.
Study Guild is free. There is nothing to buy, and if that ever changes, nobody is charged without being asked first.
2. What you add belongs to the guild
A guild is a shared deck. Anyone signed in can add a card to it or improve any card's wording, and everyone can read it, signed in or not: guilds are public pages on the open web, listed for search engines and offered to the assistants members connect. That is what makes them worth joining, and it means that adding a card is publishing it.
You keep your rights. Writing a card gives Kaperkunde no ownership of it. What you give, by adding a card, a picture, a guild or an edit, is permission: to Kaperkunde, to store it and publish it as part of Study Guild — on the site, in its feeds for search engines and assistants, and in copies and backups — for as long as Study Guild exists, without payment, anywhere in the world; and to every member, to study it, hold a wording of it in their stack, vote on it and improve it. That permission is what a guild runs on, and it cannot be taken back for a card the guild has taken up.
A card is yours to delete until others use it. While a card's score is zero or below — nobody has voted it up — you may delete it, and it disappears from the guild at once. A card that has been voted up belongs to the guild. It stays, under your public name, and stays even if you leave the guild or close your account, credited then to "a former member". The same goes for a guild you found: founding one gives you no more say over it than anyone else has, and it stays when you go.
Improving is not rewriting. Any member may improve a card's wording. Each edit is a new version, credited to whoever wrote it; learners who already hold the card keep the wording they learned, and the original is never lost. An edit that changes what the card teaches — a different fact, not a better phrasing — is refused, and only the card's author may change its links or pictures.
Add only what you may. Put into a guild only your own words and pictures, or material you have the right to share this way. Do not add anybody's personal details, yours included: a guild is not the place for them, and once a card is the guild's it cannot be taken back the way a private note could.
3. What is not acceptable
- Anything illegal, and anything sexual involving children, real or fictional.
- Harassing, threatening, impersonating or exposing a real person — in a card, a guild's name or description, your own name, or through the invite links the site sends on your behalf.
- Somebody else's work passed off as your own, or anything you do not have the right to put here.
- Cards that are not cards: advertising, spam, or links whose point is to send people somewhere else.
- Gaming the scores: extra accounts to vote with, votes traded for votes, or invite links used to farm XP.
- Attacking the service: breaking into other people's accounts, probing for holes you have not been invited to probe, scraping at a rate that hurts the site, or flooding it with cards, pictures or traffic.
Connecting an assistant is welcome and is what the connector is for. What it does under your account is your doing, as much as if you had typed it, and these rules apply to it as they apply to you.
4. Reports, and what we do about them
If a card, a guild or a member breaks these rules or the law, tell abuse@kaperkun.de, with a link to it and a line on why. A person reads it and looks. Something that plainly should not be there is removed, and something that should stays; either way the person who reported it hears what we decided, and so does the member it concerns, with the reason. If you think we got it wrong, say so in reply, and a person looks again.
We may hide or remove a card, a guild or a wording, and suspend or close an account, when that is what these rules or the law call for. We will say why, unless the law forbids it.
5. It is offered as it is
Study Guild is free, and it is offered as it is. We try to keep it up and to keep your work safe, but there is no warranty of any kind and no promise of availability, and to the extent the law allows, Kaperkunde is not liable for what you lose by relying on it. Cards are study material written by members: we do not check that they are right, and the ranks are a game, not a certificate. If you would be sorry to lose something, ask for a copy — the privacy notice says how.
6. Ending it
You can stop at any time: leave a guild from its page, and ask us to delete your account. What you contributed stays with its guilds where §2 says it does, and everything else goes with you. We can close an account that is breaking the rules above, and we will say why. If Study Guild itself ever shuts down, everyone signed up hears about it with enough notice to take their work with them.
7. Changes
These terms will change as Study Guild does. If anything changes in a way that matters to you, we will tell you rather than quietly editing the page, and the effective date at the top shows the version you are reading. Every version is kept in the public repository these terms are published from.
8. Getting in touch
Support goes to support@kaperkun.de, reports about content to abuse@kaperkun.de, questions about these terms to legal@kaperkun.de, and anything about your data to privacy@kaperkun.de. A person reads each of them, and you hear back.
Dutch law applies, and Study Guild is run by Kaperkunde, whose details are at the top of this page. If you are a consumer, nothing here takes away the protection the law of the country you live in gives you, and the European Commission's dispute-resolution platform is at https://ec.europa.eu/consumers/odr, as §17 of the Privacy Policy notes.
